Booking terms
The terms that apply to every trip we operate. Your written confirmation carries the specific figures.
1.Making a booking
A booking is confirmed when we have received your deposit and issued a written confirmation. Quotes are held for fourteen days; after that park fees, lodge rates or exchange movements may change the price. The person making the booking confirms they have authority to do so for everyone named on it.
2.Payment
A deposit is payable to confirm, with the balance due before departure — the exact amounts and dates are stated on your confirmation. Bookings made close to departure are payable in full. Bank charges on international transfers are the sender's responsibility.
3.Changes by you
We will do our best to accommodate changes and will not charge our own fee for them. Where a lodge, airline or park authority charges us to make the change, that cost is passed on at cost.
4.Cancellation by you
Cancellation charges reflect what our suppliers charge us, on a sliding scale that increases closer to departure. The schedule applying to your trip is set out on your confirmation. We strongly recommend cancellation cover as part of your travel insurance.
5.Changes by us
Itineraries are a plan, not a contract with the weather. Roads flood, parks close sections, and lodges occasionally overbook. Where we have to change something we will substitute an equivalent or better arrangement at no extra cost, and tell you as soon as we know.
6.Your safety and conduct
You must follow the instructions of your guide, ranger or mountain crew at all times, particularly regarding leaving the vehicle, distance from animals, and turning back on a trek. We reserve the right to end a trip for anyone whose behaviour endangers themselves, other guests, our staff or wildlife, without refund.
7.Insurance
Comprehensive travel insurance is a condition of travel. For mountain treks it must cover trekking and evacuation to the summit altitude of your route. We may ask to see your policy details before departure.
8.Liability
We accept responsibility for the parts of your trip we operate directly. We are not liable for loss or injury arising from the acts of independent suppliers, from events beyond reasonable control, or from your own failure to follow reasonable safety instructions. Nothing here limits liability where Kenyan law does not permit it to be limited.
9.Governing law
These terms are governed by the laws of Kenya and are subject to the exclusive jurisdiction of the Kenyan courts.
These terms are a starting point drafted for this site and should be reviewed by a Kenyan lawyer before Samaka Mara Safari Ltd relies on them commercially.
